第一章 总 则Chapter I General Provisions第一条 为珍摄社会次第纪律，保险寰球安全，保护公民、法东说念主和其他组织的正当权益，标准和保险公安机关偏执东说念主民考查照章履行次第约束职责，制定本法。
Article 1 This Law is enactedwith a view to maintaining the social security order, guaranteeingpublic safety, protecting the lawful rights and interests of thecitizens, legal persons and other organizations, regulating andensuring the lawful fulfillment of the public security administrationduties by the public security organs and the people's policemen.
第二条 苦恼寰球纪律，妨害寰球安全，扰乱东说念主身权利、财产权利，妨害社会约束，具有社会危害性，依照《中华东说念主民共和国刑法》的规则组成作歹的，照章讲究处分；尚不够刑事处罚的，由公安机关依照本法给予次第约束处罚。
Article 2 With regard to anact of disrupting public order, encroaching upon the right of theperson, the right of property or impairing social administration, ifit is of social harmfulness and constitutes any crime as provided forin the Criminal Law of the People's Republic of China, it shall besubject to criminal liabilities. If it is not serious enough to besubject to a criminal punishment, it shall, in accordance with thislaw, be subject to public security punishment by the public securityorgan.
第三条 次第约束处罚的武艺，适用本法的规则；本法莫得规则的，适用《中华东说念主民共和国行政处罚法》的相关规则。
Article 3 The provisions ofthis Law shall apply to the procedures for the public securityadministration punishments. If any matter is not covered by this Law,the relevant provisions of the Administrative Punishment Law of thePeople's Republic of China shall apply.
第四条 在中华东说念主民共和国限制内发生的违抗次第约束行为，除法律有稀奇规则的外，适用本法。
Article 4 This Law shallapply to the acts violating the public security administration withinthe territory of the People's Republic of China unless it isotherwise provided for in any law.
在中华东说念主民共和国船舶和航空器内发生的违抗次第约束行为，除法律有稀奇规则的外，适用本法。
This Law shall apply to the acts violating the publicsecurity administration that occur in the vessels and aircrafts ofthe People's Republic of China unless it is otherwise provided for inany law.
第五条 次第约束处罚必须以事实为依据，与违抗次第约束行为的性质、情节以及社会危害进程稀奇。
Article 5 The public securityadministration punishments shall be based on facts and shall besuitable for the nature and circumstances and extent of harm to thesociety caused by the act violating the public securityadministration.
实施次第约束处罚，应当公开、公平，尊重和保险东说念主权，保护公民的东说念主格尊荣。
The imposition of public security administrationpunishments shall be open and impartial, shall respect and guaranteehuman rights and shall protect the personal dignity of the citizens.
办理次第案件应当对持教化与处罚相迷惑的原则。
The principle of combining education with punishmentsshall be observed in tackling security cases.
第六条 各级东说念主民政府应当加强社会次第轮廓治理，采纳有用要领，化解社会矛盾，增进社会融合，珍摄社会巩固。
Article 6 The people'sgovernments at all levels shall strengthen the comprehensive controlof social security, shall take effective measures to solve socialcontradictions, enhance social harmony and maintain social stability.
第七条 国务院公安部门肃穆天下的次第约束职责。县级以上地方各级东说念主民政府公安机关肃穆本行政区域内的次第约束职责。
Article 7 The public securitydepartment of the State Council shall be responsible for the publicsecurity administration throughout the country. The public securityorgans of the people's governments at all levels shall be responsiblefor the public security administration within their respectiveadministrative division.
次第案件的统带由国务院公安部门规则。
The jurisdiction of security cases shall be forest forthby the public security department of the State Council.
第八条 违抗次第约束的行为对他东说念主酿成挫伤的，行为东说念主或者其监护东说念主应当照章承担民事牵累。
Article 8 Where an actviolating public security administration causes any damage to anyother person, the violator or its guardian shall bear civilliabilities under the law.
第九条 对于因民间纠纷引起的打架打仗或者损毁他东说念主财物等违抗次第约束行为，情节较轻的，公安机关不错统一处理。经公安机关统一，当事东说念主达成条约的，不予处罚。经统一未达成条约或者达成条约后不履行的，公安机关应当依照本法的规则对违抗次第约束行为东说念主给予处罚，并请问当事东说念主不错就民事争议照章向东说念主民法院拿起民事诉讼。
Article 9 With regard to theacts violating public security administration, such as fight anddestroy of property of any other person due to civil disputes, if thecircumstances are lenient, the public security organ may solve themby mediation. Upon mediation of the public security organ, if theparties concerned reach an agreement, it shall be exempted frompunishment. If no agreement is reached, or if an agreement has beenreached but not executed, the public security organ may punish theviolator of public security administration in accordance with thisLaw and inform the parties concerned that they may lodge a civillawsuit in the people's court for the civil dispute concerned.
第二章 处罚的种类和适用Chapter II Categories and Application of the Punishments Thereto第十条 次第约束处罚的种类分为：
Article 10 The publicsecurity administration punishments are classified into the followingcategories:
（一）告诫；
(1) Warning;
（二）罚金；
(2) Pecuniary penalty;
（三）行政拘留；
(3) Administrative detention; and
（四）根除公安机关披发的许可证。
(4) Revocation of the license issued by the publicsecurity organ;
对违抗次第约束的异邦东说念主，不错附加适用限期出境或者罢休出境。
Any foreigner who violates the public securityadministration may be given an additionally applicable time limit forexiting China or being expelled from China.
第十一条 办理次第案件所查获的毒品、淫污物品等犯禁品，赌具、赌资，吸食、打针毒品的用具以及胜利用于实施违抗次第约束行为的本东说念主统共的器具，应当收缴，按照规则处理。
Article 11 The drugs, obscenearticles and other prohibited articles, gambling tools, gamblingstakes, tools for drug injection, and all the tools of the violatordirectly used for committing a violation of the public securityadministration that are discovered in a public security case shall beconfiscated and disposed of in accordance with the relevantprovisions.
违抗次第约束所得的财物，追缴退还被侵害东说念主；莫得被侵害东说念主的，登记造册，公开拍卖或者按照国度相关规则处理，所得款项上缴国库。
The properties gained by violating the public securityadministration shall be confiscated and returned to the victim. Ifthere is no victim, the properties shall be recorded down and shallbe auctioned openly or shall be disposed of in accordance with therelevant provisions of the state, and the proceeds therefrom shall beturned over to the state treasury.
第十二条 已满十四周岁不悦十八周岁的东说念主违抗次第约束的，从轻或者平缓处罚；不悦十四周岁的东说念主违抗次第约束的，不予处罚，可是应当责令其监护东说念主严加管教。
Article 12 Where a person whoattains to the age of 14 but is less than 18 years old violatespublic security administration, he shall be given a lighter ormitigated punishment. Where a person who is less than 14 years oldviolates public security administration, he (she) shall be immunefrom punishment, but his guardian shall be ordered to offer himstrict custodian education.
第十三条 神经病东说念主在不成鉴别或者不成法例我方行为的时候违抗次第约束的，不予处罚，可是应当责令其监护东说念主严加看护和扶持。间歇性的神经病东说念主在精神泛泛的时候违抗次第约束的，应当给予处罚。
Article 13 If a mentallyinsane patient causes any harmful consequences at a time when he(she) is unable to understand or control his own conduct, he shall beimmune from punishment, but his (her) guardian shall be ordered tokeep him under strict watch and control and give him medicaltreatment. An intermittently mentally insane patient shall bepunished if he (she) violates the public security administration whenhe is in a normal mental state.
第十四条盲东说念主或者又聋又哑的东说念主违抗次第约束的，不错从轻、平缓或者不予处罚。
Article 14 A blind ordeaf-and-mute person who violates the administration of publicsecurity may be given a lighter or mitigated punishment or may beexempted from punishment.
第十五条 醉酒的东说念主违抗次第约束的，应当给予处罚。
Article 15 An intoxicatedperson who violates the administration of public security shall bepunished.
醉酒的东说念主在醉酒景象中，对本东说念主有危急或者对他东说念主的东说念主身、财产或者寰球安全有威胁的，应当对其采纳保护性要领不休至酒醒。
As to any intoxicated person who may face danger himself(herself) or cause danger to the body or property of any other personor to the public safety, a protective measure shall be taken tocontrol him (her) until he (she) sobers up.
第十六条 有两种以上违抗次第约束行为的，分歧决定，合并执行。行政拘留处罚合并执行的，最长不跳跃二旬日。
Article 16 Where a personcommits two or more acts violating public security administration,rulings shall be made separately but shall be executed concurrently.The maximum time period for the concurrently executed punishments asadministrative detention shall not exceed 20 days.
第十七条 共同违抗次第约束的，根据违抗次第约束行为东说念主在违抗次第约束行为中所起的作用，分歧处罚。
Article 17 Where 2 or morepersons jointly commit a violation of public security administration,they shall be punished separately on the basis of their respectiverole in the violation.
教唆、恐吓、拐骗他东说念主违抗次第约束的，按照其教唆、恐吓、拐骗的行为处罚。
Any person who instigates, coerces or induces any otherperson to violate public security administration, he (she) shall bepunished according to the act he has instigated, coerced or induced.
第十八条 单元违抗次第约束的，对其胜利肃穆的主宰东说念主员和其他胜利牵累东说念主员依照本法的规则处罚。其他法律、行政法例对归并瞥为规则给予单元处罚的，依照其规则处罚。
Article 18 Where an entityviolates public security administration, the directly liableperson-in-charge of the entity and other directly liable personsshall be punished in accordance with this Law. Where any other law oradministrative regulation prescribes any punishment on the sameviolation, the other law or administrative regulation shall prevail.
第十九条 违抗次第约束有下列情形之一的，平缓处罚或者不予处罚：
Article 19 Under any of thefollowing circumstances, the violator of public securityadministration shall be given a mitigated punishment or may beexempted from punishment:
（一）情节稀奇眇小的；
(1) The circumstances are extremely lenient;
（二）主动排除或者平缓违法恶果，并获得被侵害东说念主脸色的；
(2) The violator has eliminated or mitigated theconsequences of the illegal act on his own initiative and hasobtained the understanding of the victim;
（三）出于他东说念主恐吓或者拐骗的；
(3) He (She) committed the violation because he (she) isforced or induced to do so;
（四）主动投案，向公安机关真的评释我方的违法戾为的；
(4) He (She) surrenders himself to justice andfaithfully makes a statement about the violation to the publicsecurity organ; and
（五）有建功弘扬的。
(5) He (She) has performed meritorious services.
第二十条 违抗次第约束有下列情形之一的，从重处罚：
Article 20 Under any of thefollowing circumstances, a violator of public security administrationshall be given a heavier punishment:
（一）有较严重恶果的；
(1) Having caused rather serious consequences;
（二）教唆、恐吓、拐骗他东说念主违抗次第约束的；
(2) Instigating, coercing or inducing any other personto violate public security administration;
（三）对报案东说念主、控告东说念主、举报东说念主、证东说念主打击报复的；
(3) Revenging on the person who reported the case to thepublic security organ, the accuser, informant or witness;
（四）六个月内曾受过次第约束处罚的。
(4) Having ever been subjected to any public securityadministration punishment within 6 months.
第二十一条 违抗次第约束行为东说念主有下列情形之一，依照本法应当给予行政拘留处罚的，不执行行政拘留处罚：
Article 21 Where a violatorof public security administration is under any of the followingcircumstances, if he should be given a punishment of administrativedetention under this Law, the punishment of administrative detentionshall not be executed:
（一）已满十四周岁不悦十六周岁的；
(1) The person has attained to the age of 14 but not tothe age of 16;
（二）已满十六周岁不悦十八周岁，首次违抗次第约束的；
(2) The person has attained to the age of 16 but not tothe age of 18, and such act is committed for the first time;
（三）七十周岁以上的；
(3) The person is over 70 years old; or
（四）怀胎或者哺乳我方不悦一周岁婴儿的。
(4) The person is pregnant or breast feeds her own babywho is not one year old.
第二十二条 违抗次第约束行为在六个月内莫得被公安机关发现的，不再处罚。
Article 22 Where an actcommitted against the administration of public security is notdiscovered by the public security organ within six months, the personcommitting such act shall no longer be penalized.
前款规则的期限，从违抗次第约束行为发生之日起贪图；违抗次第约束行为有纠合或者持续景象的，从行为终了之日起贪图。
The period of time specified in the preceding paragraphshall be counted from the date the act is committed against theadministration of public security; and if such act is continual orcontinuing, the period of time shall be counted from the date the actends.
第三章 违抗次第约束的行为和处罚Chapter III Acts Violating Public Security Administration and thePunishments Thereto第一节 苦恼寰球纪律的行为和处罚
Section 1 Acts Disrupting Public Order and thePunishments Thereto
第二十三条 有下列行为之一的，处告诫或者二百元以下罚金；情节较重的，处五日以上旬日以下拘留，不错并处五百元以下罚金：
Article 23 Where a personcommits any of the following acts, he shall be given a warning or apecuniary penalty. If the circumstances are serious, he (she) shallbe detained for not less than 5 days but not more than 10 days andmay be fined 500 yuan:
（一）苦恼机关、团体、企业、工作单元纪律，甚而职责、坐蓐、营业、医疗、教学、科研不成泛泛进行，尚未酿成严重亏欠的；
(1) He (she) disturbs the order of any organ, socialorganization, enterprise or public institution and makes itimpossible for the work, production, business, medical services,teaching or scientific research to proceed normally, but has notcaused any serious loss;
（二）苦恼车站、口岸、船埠、机场、阛阓、公园、展览馆或者其他寰球步地纪律的；
(2) He (She) disturbs the order of any bus station,port, dock, civil airport, emporium, park, exhibition hall or anyother public place;
（三）苦恼寰球汽车、电车、火车、船舶、航空器或者其他寰球交通器具上的纪律的；
(3) He (She) disturbs the order of any bus, trolleybus,train, ship, aircraft or any other means of public transport;
（四）造孽胁制或者强登、扒俟无邪车、船舶、航空器以偏执他交通器具，影响交通器具泛泛行驶的；
(4) He (She) illegally stops or board any slowly goingmotor vehicle, ship, aircraft or any other means of transport andaffects the normal operation of the means of transport; or
（五）阻扰照章进行的选举纪律的。
(5) He (She) disturbs the order of any on-goingelection.
聚众实施前款行为的，对首要分子处旬日以上十五日以下拘留，不错并处一千元以下罚金。
The principal violator who gathers a crowd to commit anyof the acts as mentioned in the preceding paragraph shall be detainedfor not less than 10 days but not more than 15 days, and may be finednot more than 1, 000 yuan.
第二十四条有下列行为之一，苦恼文化、体育等大型大家性行为纪律的，处告诫或者二百元以下罚金；情节严重的，处五日以上旬日以下拘留，不错并处五百元以下罚金：
Article 24 Where a personcommits any of the following acts to disturb the order of a culturalactivity, sport or any other large scale mass activity, he (she)shall be given a warning or fined not more than 200 yuan. If thecircumstances are serious, he (she) be detained for not less than 5days but not more than 10 days, and may be fined not more than 500yuan:
（一）强行参加场内的；
(1) Entering into the venue by force;
（二）违抗规则，在场内燃放烟花炮竹或者其他物品的；
(2) Setting off fireworks and firecrackers or otherarticles in a prohibited area by violating relevant provisions;
（三）展示侮辱性口号、条幅等物品的；
(3) Showing any insulting banner, scroll or otherarticle;
（四）围攻评判员、通顺员或者其他职责主说念主员的；
(4) Besieging any referee, athlete or other workingpersonnel;
（五）向场内投掷杂物，不听制止的；
(5) Throwing sundries into the arena and refusing tostop doing so after being ordered to stop; or
（六）苦恼大型大家性行为纪律的其他行为。
(6) Other acts disturbing the order of large scale massactivities.
因苦恼体育比赛纪律被处以拘留处罚的，不错同期责令其十二个月内不得参加通顺场馆不雅看同类比赛；违抗规则参加通顺场馆的，强行带离现场。
Where a person is given a punishment of detention due todisturbing the order of a sport game, he (she) may ordered not toenter into gymnasiums to watch games of the same type. If he entersinto a gymnasium by violating the provisions, he shall be forced toleave the venue.
第二十五条 有下列行为之一的，处五日以上旬日以下拘留，不错并处五百元以下罚金；情节较轻的，处五日以下拘留或者五百元以下罚金：
Article 25 Anyone who commitsany of the following acts shall be detained for not less than 5 daysbut not more than 10 days, and may be concurrently fined 500 yuan. Ifthe circumstances are relatively lenient, he (she) shall be detainedfor less than 5 days or shall be fined not more than 500 yuan:
（一）分布谣喙，谎报险情、疫情、警情或者以其他方法挑升苦恼寰球纪律的；
(1) Intentionally disturbing public order by spreadingany rumor, giving false information about the situation of any risk,epidemic disease or emergency, or by any other means;
（二）投跌荡妄的爆炸性、粉碎性、辐照性、腐蚀性物资或者传染病病原体等危急物资苦恼寰球纪律的；
(2) Disturbing public order by throwing any fakeexplosive, toxic, radioactive or caustic substances, or any fakeinfectious disease pathogen;
（三）扬言实施纵火、爆炸、投放危急物资苦恼寰球纪律的。
(3) Disturbing public order by threat to set fire, blastor throw dangerous substances.
第二十六条 有下列行为之一的，处五日以上旬日以下拘留，不错并处五百元以下罚金；情节较重的，处旬日以上十五日以下拘留，不错并处一千元以下罚金：
Article 26 Anyone who commitsany of the following acts shall be detained for not less than 5 daysbut not more than 10 days, and may be fined not more than 500 yuan.If the circumstances are quite serious, he (she) shall be detainedfor not less than 10 days but not more than 15 days, and may be finednot more than 1, 000 yuan:
（一）结伴打仗的；
(1) Gang-fighting;
（二）追赶、胁制他东说念主的；
(2) Chasing or heading off any other person;
（三）强拿硬要或者即兴损毁、占用公私财物的；
(3) Forcibly taking or demanding, willfully damaging,destroying or appropriating any public or private property;
（四）其他挑衅生事行为。
(4) Other acts of picking a quarrel and making trouble.
第二十七条 有下列行为之一的，处旬日以上十五日以下拘留，不错并处一千元以下罚金；情节较轻的，处五日以上旬日以下拘留，不错并处五百元以下罚金：
Article 27 Anyone who commitsany of the following acts may be detained for not less than 10 daysbut not more than 15 days, and may be concurrently fined not morethan 1, 000 yuan. If the circumstances are relatively lenient, he(she) shall be detained for not less than 5 days but not more than 10days, and may be concurrently fined not more than 5, 00 yuan:
（一）组织、教唆、恐吓、拐骗、挑动他东说念主从事邪教、会说念门行为或者期骗邪教、会说念门、迷信行为，苦恼社会纪律、挫伤他东说念主肉体健康的；
(1) Organizing, instigating, intimidating, inducing orinciting any other person to carry out activities of any cult orsuperstitious sect or secret society, or disturbing the social orderor impairing the health of any other person by using any cult, orsuperstitious sect or secret society, or superstitious activity; or
（二）冒用宗教、气功理论进行苦恼社会纪律、挫伤他东说念主肉体健康行为的。
(2) Disturbing the social order or impairing the healthof any other person in the name of any religion or Qigong.
第二十八条违抗国度规则，挑升阻挠无线电业务泛泛进行的，或者对泛泛运行的无线电台（站）产生无益阻挠，经相关主宰部门指出后，拒不采纳有用要领排除的，处五日以上旬日以下拘留；情节严重的，处旬日以上十五日以下拘留。
Article 28 A person who, inviolation of State regulations, intentionally interferes with thenormal operation of the radio business, or brings about harmfulinterference with the normal operation of radio stations andrefuses to take effective measures to eliminate such interferenceafter the competent department points out the fact, shall be detainedfor not less than five days but not more than 10 days; and if thecircumstances are serious, he shall be detained for not less than 10days but not more than 15 days.
第二十九条 有下列行为之一的，处五日以下拘留；情节较重的，处五日以上旬日以下拘留：
Article 29 A person whocommits one of the following acts shall be detained for not more thanfive days; and if the circumstances are relatively serious, he shallbe detained for not less than five days but not more than 10 days:
（一）违抗国度规则，侵入贪图机信息系统，酿成危害的；
(1) in violation of State regulations, invading acomputer information system, which causes harm to the system;
（二）违抗国度规则，对贪图机信息系统功能进行删除、修改、增多、阻挠，酿成贪图机信息系统不成泛泛运行的；
(2) in violation of State regulations, deleting,changing, increasing or interfering with the functions of a computerinformation system, which makes it impossible for the system tooperate normally;
（三）违抗国度规则，对贪图机信息系统中存储、处理、传输的数据和应用武艺进行删除、修改、增多的；
(3) in violation of State regulations, deleting,changing or increasing the stored, processed ortransmitted data and the application program of a computerinformation system; or
（四）挑升制作、传播贪图机病毒等阻扰性武艺，影响贪图机信息系统泛泛运行的。
(4) intentionally making up or transmitting suchdestructive programs as computer virus, which adversely affects thenormal operation of a computer information system.
第二节 妨害寰球安全的行为和处罚
Section 2 Acts Impairing Public Security andPenalties
第三十条违抗国度规则，制造、买卖、储存、输送、邮寄、佩戴、使用、提供、处置爆炸性、粉碎性、辐照性、腐蚀性物资或者传染病病原体等危急物资的，处旬日以上十五日以下拘留；情节较轻的，处五日以上旬日以下拘留。
Article 30 A person who, inviolation of State regulations, manufactures, buys, sells, stores,transports, mails, carries, uses, provides or disposes of hazardoussubstances such as explosive, toxic, radioactive and corrosivesubstances or pathogens of infectious diseases shall be detained fornot less than 10 days but not more than 15 days; and if thecircumstances are relatively minor, he shall be detained for not lessthan five days but not more than 10 days.
第三十一条 爆炸性、粉碎性、辐照性、腐蚀性物资或者传染病病原体等危急物资被盗、被抢或者丢失，未按规则答复的，处五日以下拘留；挑升瞒哄不报的，处五日以上旬日以下拘留。
Article 31 A person who failsto report, as required by relevant regulations, when such hazardoussubstances as explosive, toxic, radioactive and corrosive substancesor pathogens of infectious diseases are stolen, robbed or lost shallbe detained for not more than five days; and if he intentionallyconceals the fact, he shall be detained for not less than five daysbut not more than 10 days.
第三十二条 造孽佩戴枪支、弹药或者弩、匕首等国度规则的管制器具的，处五日以下拘留，不错并处五百元以下罚金；情节较轻的，处告诫或者二百元以下罚金。
Article 32 A person whoillegally carries such implements under control according to Stateregulations as firearms and ammunition, or crossbows and daggersshall be detained for not more that five days and may, in addition,be fined not more than 500 yuan; and if the circumstances arerelatively minor, he shall be given a warning or be fined not morethan 200 yuan.
造孽佩戴枪支、弹药或者弩、匕首等国度规则的管制器具参加寰球步地或者寰球交通器具的，处五日以上旬日以下拘留，不错并处五百元以下罚金。
A person who illegally carries such implements undercontrol according to State regulations as firearms and ammunition, orcrossbows and daggers to a public place or aboard a publictransportation means shall be detained for not less than five daysbut not more than 10 days and may, in addition, be fined not morethan 500 yuan.
第三十三条 有下列行为之一的，处旬日以上十五日以下拘留：
Article 33 A person whocommits one of the following acts shall be detained for not less than10 days but not more than 15 days:
（一）盗窃、损毁油气管说念设施、电力电信设施、播送电视设施、水利防汛工程设施或者水文监测、测量、征象测报、环境监测、地质监测、地震监测等寰球设施的；
(1) stealing or destroying oil or gas pipelineinstallations, electric power and telecommunications facilities,radio and TV facilities, and waterconservancyand floodcontrolengineering facilities, or such public utilities as ones forhydrological monitoring, hydrographic survey, meteorologicalmonitoring and weather forecast, environmental monitoring, geologicalmonitoring and seismologic monitoring;
（二）移动、损毁国度边境的界碑、界桩以偏执他边境符号、边境设施或者河山、领海符号设施的；
(2) moving to another place or destroying boundarytablets and markers of the national border and other boundary markersand installations, or marking installations of territorial land andwaters; or
（三）造孽进行影响国（边）界线走向的行为或者修建有碍国（边）境约束的设施的。
(3) conducting illegal activities affecting thealignment of the national border (frontier) line, or constructinginstallations which hampers national border (frontier)administration.
第三十四条 盗窃、损坏、私行移动使用中的航空设施，或者强行参加航空器驾驶舱的，处旬日以上十五日以下拘留。

A person who uses implements or tools aboard an aircraftin use, which may impair the normal function of the navigationsystem, and turns a deaf ear to dissuasions shall be detained for notmore than five days or be fined not more than 500 yuan.
第三十五条 有下列行为之一的，处五日以上旬日以下拘留，不错并处五百元以下罚金；情节较轻的，处五日以下拘留或者五百元以下罚金：
Article 35 A person whocommits one of the following acts shall be detained for not less thanfive days but not more than 10 days and may, in addition, be finednot more than 500 yuan; and if the circumstances are relativelyminor, he shall be detained for not more than five days or be finednot more than 500 yuan:
（一）盗窃、损毁或者私行移动铁路设施、开荒、机车车辆配件或者安全符号的；
(1) stealing, destroying or moving to another placewithout permission railway facilities, equipment, rolling stockappendages or safety markers;
（二）在铁路领路上抛弃艰难物，或者挑升向列车投掷物品的；
(2) placing obstacles on railway lines, or intentionallythrowing things to trains;
（三）在铁路领路、桥梁、涵洞处挖掘坑穴、采石取沙的；
(3) digging holes or quarrying and taking sand alongrailway lines, on bridges or in culverts; or
（四）在铁路领路上私设说念口或者平交过说念的。
(4) privately setting up road junctions or levelcrossings on railway lines.
第三十六条 私行参加铁路重视网或者火车驾临时在铁路领路上行走坐卧、抢越铁路，影响行车安全的，处告诫或者二百元以下罚金。
Article 36 A person whoenters railway shelter networks without permission or walks, sits orlies down on railway lines, or rushes across railway lines when atrain is approaching, which endangers traffic safety, shall be givena warning or be fined not more than 200 yuan.
第三十七条 有下列行为之一的，处五日以下拘留或者五百元以下罚金；情节严重的，处五日以上旬日以下拘留，不错并处五百元以下罚金：
Article37 A person whocommits one of the following acts shall be detained for not more thanfive days or be fined not more than 500 yuan; and if thecircumstances are serious, he shall be detained for not less thanfive days but not more than 10 days and may, in addition, be finednot more than 500 yuan:
（一）未经批准，装置、使用电网的，或者装置、使用电网不相宜安全规则的；
(1)installing or using electrified wirenettingswithout permission, or installing or using them at variance with theregulations on safety;
（二）在车辆、行东说念主通行的地方施工，对沟井坎穴不设覆盖物、防围和警示符号的，或者挑升损毁、移动覆盖物、防围和警示符号的；
(2)failing to place covers, fences or warning signs for ditches, wells,ridges and holes when engaging in construction at places wherevehicles and pedestrians pass, or intentionally destroying or movingto another place the covers, fences or warning signs; or
（三）盗窃、损毁路面井盖、照明等寰球设施的。
(3)stealing or destroying such public utilities as well covers on roadsurfaces and lighting facilities.
第三十八条 举办文化、体育等大型大家性行为，违抗相关规则，有发生安全事故危急的，责令罢手行为，立即疏散；对组织者处五日以上旬日以下拘留，并处二百元以上五百元以下罚金；情节较轻的，处五日以下拘留或者五百元以下罚金。
Article38 Where an accidentendangering safety may occur during such largescalemass activities as cultural and sports activities held in violationof relevant regulations, such activities shall be ordered to stop,and the participants shall be immediately evacuated; the organizershall be detained for not less than five days but not more than 10days and shall, in addition, be fined not less than 200 yuan but notmore than 500 yuan; and if the circumstances are relatively minor, heshall be detained for not more than five days or be fined not morethan 500 yuan.
第三十九条 栈房、饭铺、影剧院、文娱场、通顺场、展览馆或者其他供社会公众行为的步地的规划约束东说念主员，违抗安全规则，甚而该步地有发生安全事故危急，经公安机关责令改正，拒不改正的，处五日以下拘留。
Article39 Where the managerof a hotel, restaurant, cinema, theater, entertainment center, sportsground, exhibition hall or other places for public activitiesviolates regulations on safety, so that an accident endangeringsafety may occur at such a place, and refuses to rectify after apublic security organ orders him to do so, he shall be detained fornot more than five days.
第三节 扰乱东说念主身权利、财产权利的行为和处罚
Section3 Acts Infringing upon Rights of the Person and of Property andPenalties
第四十条 有下列行为之一的，处旬日以上十五日以下拘留，并处五百元以上一千元以下罚金；情节较轻的，处五日以上旬日以下拘留，并处二百元以上五百元以下罚金：
Article 40 If a personcommits one of the following acts, he shall be detained for not lessthan 10 days but not more than 15 days and shall, in addition, befined not less than 500 yuan but not more than 1,000 yuan; and if thecircumstances are relatively minor, he shall be detained for not lessthan five days but not more than 10 days and shall, in addition, befined not less than 200 yuan but not more than 500 yuan:
性技巧（一）组织、恐吓、拐骗不悦十六周岁的东说念主或者残疾东说念主进行恐怖、暴戾扮演的；
(1) organizing or coercing persons who have not attainedto the age of 16 or who are disabled to give terrifying or inhumaneperformances, or luring such persons into giving such performances;
（二）以暴力、威胁或者其他本事将就他东说念主服务的；
(2) forcing another person to work by means of violenceor threat or other means; or
（三）造孽限制他东说念主东说念主身解放、造孽侵入他东说念主住宅或者造孽搜查他东说念主肉体的。
(3) illegally restricting another person’s freedom ofthe person, illegally breaking into another person’s house orillegally making a body search of another person.
第四十一条 恐吓、拐骗或者期骗他东说念主乞讨的，处旬日以上十五日以下拘留，不错并处一千元以下罚金。
Article 41 A person whocoerces another person to go begging, lures such person into beggingor uses the person in begging shall be detained for not less than 10days but not more than 15 days and may, in addition, be fined notmore than 1,000 yuan
反复纠缠、强行讨要或者以其他滋扰他东说念主的气象乞讨的，处五日以下拘留或者告诫。
A person who continually pesters or forcibly begs fromanother person or begs by other irritating means shall be detainedfor not more than five days or be given a warning.
第四十二条 有下列行为之一的，处五日以下拘留或者五百元以下罚金；情节较重的，处五日以上旬日以下拘留，不错并处五百元以下罚金：
Article 42 A person whocommits one of the following acts shall be detained for not more thanfive days or be fined not more than 500 yuan; and if thecircumstances are relatively serious, he shall be detained for notless than five days but not more than 10 days and may, in addition,be fined not more than 500 yuan:
（一）写恐吓信或者以其他方法威胁他东说念主东说念主身安全的；
(1) writing letters of intimidation or threatening thepersonal safety of another person by other means;
（二）公然侮辱他东说念主或者执造事实攻讦他东说念主的；
(2) openly humiliating another person or slanderinganother person by fabricating stories;
（三）执造事实诬蔑谋害他东说念主，企图使他东说念主受到刑事讲究或者受到次第约束处罚的；
(3) framingupanother person by fabricating stories in an attempt to make theperson subject to criminal investigation or to penalty foradministration of public security;
（四）对质东说念主偏执嫡支属进行威胁、侮辱、殴打或者打击报复的；
(4) threatening, humiliating or beating up a witness orhis close relative or retaliating against either of them;
（五）屡次发送淫秽、侮辱、恐吓或者其他信息，阻挠他东说念主泛泛生计的；
(5) repeatedly dispatching pornographic, humiliating,intimidating or other information to disturb the normal life ofanother person; or
（六）偷窥、偷拍、窃听、分布他东说念主阴事的。
(6) peeping, secretly taking photos, eavesdropping, orspreading the privacy of another person.
第四十三条 殴打他东说念主的，或者挑升伤害他东说念主肉体的，处五日以上旬日以下拘留，并处二百元以上五百元以下罚金；情节较轻的，处五日以下拘留或者五百元以下罚金。
Article 43 A person who beatsup another person, or intentionally hurts the body of another personshall be detained for not less than five days but not more than 10days and shall, in addition, be fined not less than 200 yuan but notmore than 500 yuan; and if the circumstances are relatively minor, heshall be detained for not more than five days or be fined not morethan 500 yuan
有下列情形之一的，处旬日以上十五日以下拘留，并处五百元以上一千元以下罚金：
A person who commits one of the following acts shall bedetained for not less than 10 days but not more than 15 days andshall, in addition, be fined not less than 500 yuan but not more than1,000 yuan:
（一）结伴殴打、伤害他东说念主的；
gangfightingand hurting another person;
（二）殴打、伤害残疾东说念主、妊妇、不悦十四周岁的东说念主或者六十周岁以上的东说念主的；
beatingup and hurting a disabled person, pregnant woman, or a person whohas not attained to the age of 14 or who is over 60 years old; or
（三）屡次殴打、伤害他东说念主或者一次殴打、伤害多东说念主的。
(3) beating up and hurting another person for more thantwo times, or beating up and hurting more than two persons once.
第四十四条 猥亵他东说念主的，或者在寰球步地挑升涌现肉体，情节恶劣的，处五日以上旬日以下拘留；猥亵智商残疾东说念主、神经病东说念主、不悦十四周岁的东说念主或者有其他严重情节的，处旬日以上十五日以下拘留。
Article 44 A person whomolests another person or intentionally exposes his/her body in apublic place, if the circumstances are abominable, shall be detainedfor not less than five days but not more than 10 days; if a personmolests a mentally disabled person, or a person suffering mentaldisorder, or a person who has not attained to the age of 14, orcommits such act with other serious circumstances, he shall bedetained for not less than 10 days but not more than 15 days.
第四十五条 有下列行为之一的，处五日以下拘留或者告诫：
Article 45 A person whocommits one of the following acts shall be detained for not more thanfive days or be given a warning:
（一）残酷家庭成员，被残酷东说念主要求处理的；
(1) maltreating a family member, who demands handling ofthe matter; or
（二）松手莫得安祥生计才能的被赡养东说念主的。
(2) abandoning a supported person who can not look afterhimself.
第四十六条 强买强卖商品，将就他东说念主提供服务或者将就他东说念主接受服务的，处五日以上旬日以下拘留，并处二百元以上五百元以下罚金；情节较轻的，处五日以下拘留或者五百元以下罚金。
Article 46 A person whoforcibly buys or sells commodities, forces another person to provideservices or to accept services shall be detained for not less thanfive days but not more than 10 days and shall, in addition, be finednot less than 200 yuan but not more than 500 yuan; and if thecircumstances are relatively minor, he shall be detained for not morethan five days or be fined not more than 500 yuan.
第四十七条 挑动民族仇恨、民族愤慨，或者在出书物、贪图机信息汇集中刊载民族愤慨、侮辱试验的，处旬日以上十五日以下拘留，不错并处一千元以下罚金。
Article 47 A person whoincites national hatred or national discrimination, or publishescontents about national discrimination or humiliation in publicationsor computer information networks shall be detained for not less than10 days but not more than 15 days and may, in addition, be fined notmore than 1,000 yuan.
第四十八条 冒领、归隐、毁弃、暗里开拆或者造孽检察他东说念主邮件的，处五日以下拘留或者五百元以下罚金。
Article 48 A person whoclaims under false pretences, hides, destroys, discards, stealthilyopens or illegally examines the mail of another person shall bedetained for not more than five days or be fined not more than 500yuan.
第四十九条 盗窃、骗取、哄抢、劫掠、敲诈欺诈或者挑升损毁公私财物的，处五日以上旬日以下拘留，不错并处五百元以下罚金；情节较重的，处旬日以上十五日以下拘留，不错并处一千元以下罚金。
Article 49 A person whosteals, defrauds, forcibly seizes, openly robs, racketeers orintentionally destroys public or private property shall be detainedfor not less than five days but not more than 10 days and may, inaddition, be fined not more than 500 yuan; and if the circumstancesare relatively serious, he shall be detained for not less than 10days but not more than 15 days and may, in addition, be fined notmore than 1,000 yuan.
第四节 妨害社会约束的行为和处罚
Section 4 Acts Impeding Social Administration andPenalties
第五十条 有下列行为之一的，处告诫或者二百元以下罚金；情节严重的，处五日以上旬日以下拘留，不错并处五百元以下罚金：
Article 50 A person whocommits one of the following acts shall be given a warning or befined not more than 200 yuan; and if the circumstances are serious,he shall be detained for not less than five days but not more than 10days, and may, in addition, be fined not more than 500 yuan:
（一）拒不执行东说念主民政府在辗转景象情况下照章发布的决定、号令的；
(1) refusing to carry out the decision or order issuedaccording to law by the people’s government in a state ofemergency;
（二）阻滞国度机关职责主说念主员照章执行职务的；
(2) obstructing the staff member of a governmentdepartment from performing his duties according to law;
（三）阻滞执行辗转任务的消防车、救护车、工程抢险车、警车等车辆通行的；
(3) obstructing the passage of such vehicles as fireengines, ambulances, engineering emergency trucks and patrol wagonson emergency duties; or
（四）强行冲闯公安机关竖立的警告带、警告区的。
(4) forcibly breaking through a warning belt or area setup by a public security organ.
阻滞东说念主民考查照章执行职务的，从重处罚。
A person who obstructs the people’s police fromperforming their duties according to law shall be given a heavierpenalty.
第五十一条 冒充国度机关职责主说念主员或者以其他诞妄身份冒名行骗的，处五日以上旬日以下拘留，不错并处五百元以下罚金；情节较轻的，处五日以下拘留或者五百元以下罚金。
Article 51 A person whopretends to be a staff member of a government department or usesanother false identity to practice fraud shall be detained for notless than five days but not more than 10 days and may, in addition,be fined not more than 500 yuan; and if the circumstances arerelatively minor, he shall be detained for not more than five days orbe fined not more than 500 yuan.
冒流放警东说念主员冒名行骗的，从重处罚。
If a person cheats people by passing himself off as amember of the army or the police, he shall be given a heavier penalty
第五十二条 有下列行为之一的，处旬日以上十五日以下拘留，不错并处一千元以下罚金；情节较轻的，处五日以上旬日以下拘留，不错并处五百元以下罚金：
Article 52 A person whocommits one of the following acts shall be detained for not less than10 days but not more than 15 days and may, in addition, be fined notmore than 1,000 yuan; and if the circumstances are relatively minor,he shall be detained for not less than five days but not more than 10days and may, in addition, be fined not more than 500 yuan:
（一）伪造、变造或者买卖国度机关、东说念主民团体、企业、工作单元或者其他组织的公文、证件、评释文献、钤记的；
(1) forging, altering, buying or selling officialdocuments, certificates, testimonial papers or seals of a governmentdepartment, people’s organization, enterprise, institution or otherorganization;
（二）买卖或者使用伪造、变造的国度机关、东说念主民团体、企业、工作单元或者其他组织的公文、证件、评释文献的；
(2) buying, selling or using forged or altered officialdocuments, certificates or testimonial papers of a governmentdepartment, people’s organization, enterprise, institution or otherorganization;
（三）伪造、变造、倒卖车票、船票、航空客票、文艺献技票、体育比赛入场券或者其他有价票证、凭证的；
(3) forging, altering, reselling train or bus tickets,ship tickets, air tickets, admission tickets for theatricalperformances or sports competitions, or other negotiable bills orvouchers; or
（四）伪造、变造船舶户牌，买卖或者使用伪造、变造的船舶户牌，或者涂改船舶发动机号码的。
(4) forging or altering a certificate of vesselregistration, buying, selling or using a forged or alteredcertificate of vessel registration, or altering the number of avessel engine.
第五十三条 船舶私行参加、泊岸国度回绝、限制参加的水域或者岛屿的，对船舶肃穆东说念主及相关牵累东说念主员处五百元以上一千元以下罚金；情节严重的，处五日以下拘留，并处五百元以上一千元以下罚金。
Article 53 Where a vessel,without permission, enters or berths at the waters or islands, whichthe State forbids or restricts, the leading person of the vessel andthe person to be held responsible shall each be fined not less than500 yuan but not more than 1,000 yuan; and if the circumstances areserious, they shall each be detained for not more than five days andshall, in addition, be fined not less than 500 yuan but not more than1,000 yuan.
第五十四条 有下列行为之一的，处旬日以上十五日以下拘留，并处五百元以上一千元以下罚金；情节较轻的，处五日以下拘留或者五百元以下罚金：
Article 54 A person whocommits one of the following acts shall be detained for not less than10 days but not more than 15 days and shall, in addition, be finednot less than 500 yuan but not more than 1,000 yuan; and if thecircumstances are relatively minor, he shall be detained for not morethan five days or be fined not more than 500 yuan:
（一）违抗国度规则，未经注册登记，以社会团体理论进行行为，被取缔后，仍进行行为的；
(1) continuing to engage in activities in the name of apublic organization after it is banned because, in violation of Stateregulations, it engages in activities without registration;
（二）被照章破除登记的社会团体，仍以社会团体理论进行行为的；
(2) continuing to engage in activities in the name of apublic organization after its registration is cancelled according tolaw; or
（三）未经许可，私行规划按照国度规则需要由公安机关许可的行业的。
(3) without a license, operating a business for which,according to State regulations, a license issued by a public securityorgan is required.
有前款第三项行为的，给以取缔。
The act mentioned in Subparagraph (3) of the precedingparagraph shall be banned.
获得公安机关许可的规划者，违抗国度相关约束规则，情节严重的，公安机关不错根除许可证。
If a business operator who has obtained a license from apublic security organ violates the relevant administrativeregulations of the State and the circumstances are serious, thepublic security organ may revoke its license.
第五十五条 挑动、操办造孽齐集、游行、请愿，不听规劝的，处旬日以上十五日以下拘留。
Article 55 A person whoincites or engineers an illegal gathering, parade or demonstrationand refuses to listen to dissuasions shall be detained for not lessthan 10 days but not more than 15 days.
第五十六条 栈房业的职责主说念主员对住宿的搭客不按规则登记姓名、身份证件种类和号码的，或者明知住宿的搭客将危急物资带入栈房，不予制止的，处二百元以上五百元以下罚金。
Article 56 If a worker of the hotel industry fails toregister the name or the type and number of the identificationcertificate of a lodging guest in accordance with relevantregulations, or knowingly fails to stop a lodging guest from bringinghazardous substances into the hotel, he shall be fined not less than200 yuan but not more than 500 yuan.
栈房业的职责主说念主员明知住宿的搭客是作歹嫌疑东说念主员或者被公安机关通缉的东说念主员，不向公安机关答复的，处二百元以上五百元以下罚金；情节严重的，处五日以下拘留，不错并处五百元以下罚金。
If a worker of the hotel industry fails to report to thepublic security organ when he clearly knows that a lodging guests isa criminal suspect or is wanted by the public security organ, heshall be fined not less than 200 yuan but not more than 500 yuan; andif the circumstances are serious, he shall be detained for not morethan five days and may, in addition, be fined not more than 500 yuan.
第五十七条 房屋出租东说念主将房屋出租给无身份证件的东说念主居住的，或者不按规则登记承租东说念主姓名、身份证件种类和号码的，处二百元以上五百元以下罚金。
Article 57 Where a houselessor leases out his house to a person without an identificationcertificate, or fails to register the name or type and number of theidentification certificate of the lessee in accordance with relevantregulations, he shall be fined not less than 200 yuan but not morethan 500 yuan.
房屋出租东说念主明知承租东说念主期骗出租房屋进行作歹行为，不向公安机关答复的，处二百元以上五百元以下罚金；情节严重的，处五日以下拘留，不错并处五百元以下罚金。
If a house lessor fails to report to the public securityorgan when he clearly knows that the lessee is making use of thehouse for criminal activities, he shall be fined not less than 200yuan but not more than 500 yuan; and if the circumstances areserious, he shall be detained for not more than five days and may, inaddition, be fined not more than 500 yuan.
第五十八条 违抗对于社会生计噪声混浊防治的法律规则，制造噪声阻挠他东说念主泛泛生计的，处告诫；告诫后不改正的，处二百元以上五百元以下罚金。
Article 58 A person who, inviolation of the provisions of the law on prevention and control ofpollution by the noise emitted in the course of social activities,makes noise to impair the daily life of another person shall be givena warning; and if he fails to make amends after the warning, he shallbe fined not less than 200 yuan but not more than 500 yuan.
第五十九条 有下列行为之一的，处五百元以上一千元以下罚金；情节严重的，处五日以上旬日以下拘留，并处五百元以上一千元以下罚金：
Article 59 If a personcommits one of the following acts, he shall be fined not less than500 yuan but not more than 1,000 yuan; and if the circumstances areserious, he shall be detained for not less than five days but notmore than 10 days and shall, in addition, be fined not less than 500yuan but not more than 1,000 yuan:
（一）典当业职责主说念主员联络典当的物品，不检察相关评释、不履行登记手续，或者明知是违法作歹嫌疑东说念主、赃物，不向公安机关答复的；
(1) where the worker of a pawnshop is concerned, failingto examine the relevant certificates or to go through the formalitiesof registration in dealing with the Article pawned, or failing toreport to the public security organ when he clearly knows that thepawner is criminal suspect who violates the law and the Article issomething stolen;
（二）违抗国度规则，收购铁路、油田、供电、电信、矿山、水利、测量和城市公用设施等废旧专用器材的；
(2) in violation of State regulations, purchasing wasteand old equipment specially used for railways, oilfields, powersupply, telecommunications, mineral mines, water conservancy andsurvey as well as urban public utilities;
（三）收购公安机关通报巡逻的赃物或者有赃物嫌疑的物品的；
(3) purchasing stolen goods searched for in the circularof a public security organ, or suspected stolen goods; or
（四）收购国度回绝收购的其他物品的。
(4) purchasing of other Articles, which is prohibited bythe State.
第六十条 有下列行为之一的，处五日以上旬日以下拘留，并处二百元以上五百元以下罚金：
Article 60 A person whocommits one of the following acts shall be detained for not less thanfive days but not more than 10 days and shall, in addition, be finednot less 200 yuan but not more than 500 yuan:
（一）掩饰、转机、变卖或者损毁行政司法机关照章扣押、查封、冻结的财物的；
(1) hiding, transferring, selling off or destroying theproperty or thing of value distrained, sealed up or frozen by anadministrative lawenforcementorgans according to law;
（二）伪造、归隐、烧毁把柄或者提供诞妄证言、谎报案情，影响行政司法机关照章办案的；
(2) forging, concealing or destroying evidence, orproviding false testimony or giving false information about a case,which affects the administrative lawenforcementorgan in dealing with the case according to law;
（三）明知是赃物而窝藏、转机或者代为销售的；
(3) knowingly harboring, transferring or selling stolengoods for another person; or
（四）被照章执行管制、褫夺政事权利或者在缓刑、保外就医等监外执行中的监犯或者被照章采纳刑事强制要领的东说念主，有违抗法律、行政法例和国务院公安部门相关监督约束规则的行为。
(4) where a criminal being put under surveillance ordeprived of political rights according to law, serving a sentenceoutside the prison under surveillance, such as being under suspendedexecution of a sentence and being released on medical parole, or aperson being subjected to compulsory criminal measures according tolaw is concerned, committing an act in violation of laws,administrative regulations or of the regulations of the publicsecurity department under the State Council on supervision andcontrol.
第六十一条 协助组织或者输送他东说念主偷越国（边）境的，处旬日以上十五日以下拘留，并处一千元以上五千元以下罚金。
Article 61 A person whoassists in making arrangements for another person illegally to cross,or transports another person across, the national border (frontier)shall be detained for not less than 10 days but not more than 15 daysand shall, in addition, be fined not less than 1,000 yuan but notmore than 5,000 yuan
第六十二条 为偷越国（边）境东说念主员提供条目的，处五日以上旬日以下拘留，并处五百元以上二千元以下罚金。

Article 63 A person whocommits one of the following acts shall be given a warning or befined not more than 200 yuan; and if the circumstances are relativelyserious, he shall be detained for not less than five days but notmore than 10 days and shall, in addition, be fined not less than 200yuan but not more than 500 yuan:
（一）刻划、涂污或者以其他气象挑升损坏国度保护的文物、名胜遗址的；
(1) cutting, smearing or deliberately damaging by othermeans cultural relics, scenic spots or historic sites protected bythe State; or
（二）违抗国度规则，在文物保护单元隔壁进行爆破、挖掘等行为，危及文物安全的。
(2) in violation of State regulations, conducting suchactivities as blasting and excavation in the vicinity of historic andcultural sites under State protection, which threatens the safety ofcultural relics.
第六十四条 有下列行为之一的，处五百元以上一千元以下罚金；情节严重的，处旬日以上十五日以下拘留，并处五百元以上一千元以下罚金：
Article 64 A person whocommits one of the following acts shall be fined not less than 500yuan but not more than 1,000 yuan; and if the circumstances areserious, he shall be detained for not less than 10 days but not morethan 15 days and shall, in addition, be fined not less than 500 yuanbut not more than 1,000 yuan:
（一）偷开他东说念主无邪车的；
(1) driving another person’s motor vehicle withoutpermission; or
（二）未获得驾驶证驾驶或者偷开他东说念主航空器、无邪船舶的。
(2) driving without obtaining a driver’s license orwithout permission another person’s aircraft or motor vessel.
第六十五条 有下列行为之一的，处五日以上旬日以下拘留；情节严重的，处旬日以上十五日以下拘留，不错并处一千元以下罚金：
Article 65 A person whocommits one of the following acts shall be detained for not less thanfive days but not more than 10 days; and if the circumstances areserious, he shall be detained for not less than 10 days but not morethan 15 days and may, in addition, be fined not more than 1,000 yuan:
（一）挑升阻扰、污损他东说念主宅兆或者毁坏、丢弃他东说念主尸骨、骨灰的；
(1) intentionally destroying or defacing the grave ofanother person’s, or damaging or discarding the remains or ashes ofanother person’s; or
（二）在寰球步地停放尸体或者因停放尸体影响他东说念主泛泛生计、职责纪律，不听规劝的。
(2) placing a corpse at a public place, or disturbinganother person’s normal life or work order due to the placing of acorpse and refusing to listen to dissuasion.
第六十六条 卖淫、嫖娼的，处旬日以上十五日以下拘留，不错并处五千元以下罚金；情节较轻的，处五日以下拘留或者五百元以下罚金。
Article 66 A prostitute or aperson who goes whoring shall be detained for not less than 10 daysbut not more than 15 days and may, in addition, be fined not morethan 5,000 yuan; and if the circumstances are relatively minor, sheor he shall be detained for not more than five days or be fined notmore than 500 yuan
在寰球步地拉客招嫖的，处五日以下拘留或者五百元以下罚金。
A person who, at a public place, touts for prostitutionor invites another person for whoring shall be detained for not morethan five days or be fined not more than 500 yuan.
第六十七条 提示、容留、先容他东说念主卖淫的，处旬日以上十五日以下拘留，不错并处五千元以下罚金；情节较轻的，处五日以下拘留或者五百元以下罚金。
Article 67 A person whoseduces, shelters or introduces another person to engage inprostitution shall be detained for not less than 10 days but not morethan 15 days and may, in addition, be fined not more than 5,000 yuan;and if the circumstances are relatively minor, he shall be detainedfor not more than five days or be fined not more than 500 yuan.
第六十八条 制作、输送、复制、出售、出租淫秽的书刊、图片、影片、音像成品等淫污物品或者期骗贪图机信息汇集、电话以偏执他通信器具传播淫秽信息的，处旬日以上十五日以下拘留，不错并处三千元以下罚金；情节较轻的，处五日以下拘留或者五百元以下罚金。
Article 68 A person whoproduces, transports, duplicates, sells or lends pornographicmaterials including books, periodicals, pictures, movies andaudiovideo products, ordisseminates pornographic information by making use of computerinformation networks, telephones or other means of communicationsshall be detained for not less than 10 days but not more than 15 daysand may, in addition, be fined not more than 3,000 yuan; and if thecircumstances are relatively minor, he shall be detained for not morethan five days or be fined not more than 500 yuan.
第六十九条 有下列行为之一的，处旬日以上十五日以下拘留，并处五百元以上一千元以下罚金：
Article69 A person who commits one of the followingacts shall be detained for not less than 10 days but not more than 15days and shall, in addition, be fined not less than 500 yuan but notmore than 1,000 yuan:
（一）组织播放淫秽音像的；
(1) arranging for broadcasting pornographic audio orvideo tapes;
（二）组织或者进行淫秽扮演的；
(2) arranging for or giving obscene performances; or
（三）参与聚众淫乱行为的。
(3) joining a crowd in licentious activities.
明知他东说念主从预先款行为，为其提供条目的，依照前款的规则处罚。
A person who provides conditions to people while clearlyknowing that they are engaged in the activities specified in thepreceding paragraph shall be penalized in accordance with theprovisions of the preceding paragraph.
第七十条 以渔利为指标，为赌博提供条目的，或者参与赌博赌资较大的，处五日以下拘留或者五百元以下罚金；情节严重的，处旬日以上十五日以下拘留，并处五百元以上三千元以下罚金。
Article 70 A person whoprovides conditions for gambling for the purpose of making profits,or participates in gambling with a relatively big amount of money,shall be detained for not more than five days or be fined not morethan 500 yuan; and if the circumstances are serious, he shall bedetained for not less than 10 days but not more than 15 days andshall, in addition, be fined not less than 500 yuan but not more than3,000 yuan.
第七十一条 有下列行为之一的，处旬日以上十五日以下拘留，不错并处三千元以下罚金；情节较轻的，处五日以下拘留或者五百元以下罚金：
Article 71 A person whocommits one of the following acts shall be detained for not less than10 days but not more than 15 days and may, in addition, be fined notmore than 3,000 yuan; and if the circumstances are relatively minor,he shall be detained for not more than five days or be fined not morethan 500 yuan:
（一）造孽栽种罂粟不悦五百株或者其他极少毒品原植物的；
(1) illegally cultivating opium poppies of less than 500plants or a small number of mother plants of other narcotic drugs;
（二）造孽买卖、输送、佩戴、持有极少未经灭活的罂粟等毒品原植物种子或者幼苗的；
(2) illegally buying, selling, transporting, carrying orpossessing a small quantity of the seeds or seedlings of the motherplants of narcotic drugs, such as the opium poppy, which have notbeen inactivated; or
（三）造孽输送、买卖、储存、使用极少罂粟壳的。
(3) illegally transporting, buying, selling, storing orusing a small quantity of opium poppy shells.
有前款第一项行为，在熟习前自行清除的，不予处罚。
A person who commits the act specified in Subparagraph(1) of the preceding paragraph uproots the plants, of his own accord,before they are ripe shall not be penalized.
第七十二条 有下列行为之一的，处旬日以上十五日以下拘留，不错并处二千元以下罚金；情节较轻的，处五日以下拘留或者五百元以下罚金：
Article 72 A person whocommits one of the following acts shall be detained for not less than10 days but not more than 15 days and may, in addition, be fined notmore than 2,000 yuan; and if the circumstances are relatively minor,he shall be detained for not more than five days or be fined not morethan 500 yuan:
（一）造孽持有烟土不悦二百克、海洛因或者甲基苯丙胺不悦十克或者其他极少毒品的；
(1) illegally possessing opium of less than 200 grams,heroin or methamphetamine of less than 10 grams or a small amount ofother narcotic drugs;
（二）向他东说念主提供毒品的；
(2) providing another person with narcotic drugs;
（三）吸食、打针毒品的；
(3) ingesting or injecting narcotic drugs; or
（四）恐吓、欺骗医务东说念主员开具麻醉药品、精神药品的。
(4) coercing a medical worker to prescribe narcoticdrugs or psychotropic substances or cheating the worker into doingthe same.
第七十三条 教唆、提示、欺骗他东说念主吸食、打针毒品的，处旬日以上十五日以下拘留，并处五百元以上二千元以下罚金。
Article 73 A person whoinstigates, lures or cheats another person to or into drug ingestionor injection shall be detained for not less than 10 days but not morethan 15 days and shall, in addition, be fined not less than 500 yuanbut not more than 2,000 yuan.
第七十四条 栈房业、饮食服务业、文化文娱业、出租汽车业等单元的东说念主员，在公安机关查处吸毒、赌博、卖淫、嫖娼行为时，为违法作歹行为东说念主透风报信的，处旬日以上十五日以下拘留。
Article 74 When the publicsecurity organ investigates and deals with drug ingestion orinjection, gambling, prostitution or whoring activities, a worker ofthe hotel industry, catering trade, cultural and recreationalindustry, taxi trade, etc providing the information to a person whocommits a crime in violation of law shall be detained for not lessthan 10 days but not more than 15 days.
第七十五条 饲养动物，阻挠他东说念主泛泛生计的，处告诫；告诫后不改正的，或者放任动物恐吓他东说念主的，处二百元以上五百元以下罚金。
Article 75 A person whoraises animals, which disturbs the daily life of another person,shall be given a warning; if he fails to make amends after thewarning is given, or connives at his animals, scaring another person,he shall be fined not less than 200 yuan but not more than 500 yuan.
驱使动物伤害他东说念主的，依照本法第四十三条第一款的规则处罚。
A person who unleashes his animal to hurt another personshall be penalized in accordance with the provisions of the firstparagraph of Article 43 of this Law.
第七十六条 有本法第六十七条、第六十八条、第七十条的行为，屡教不改的，不错按照国度规则采纳强制性教化要领。
Article 76 Where a person whocommits an act specified in Articles 67, 68 and 70 refuses to makeamends despite repeated admonition, compulsory educational measuresmay be adopted in accordance with State regulations.
第四章 处罚武艺ChapterIV Procedure of Penalties第一节 调 查
Section 1 Investigation
第七十七条 公安机关对报案、控告、举报或者违抗次第约束行为东说念主主动投案，以偏执他行政主宰部门、司法机关移送的违抗次第约束案件，应当实时受理，并进行登记。
Article 77 A public securityorgan shall, in a timely manner, accept a case reported, accused orinformed of, or the voluntary surrender of a person who acts againstthe administration of public security, as well as cases of actsagainst the administration of public security transferred by anotheradministrative department or judicial organ, and have the caseregistered.
第七十八条 公安机关受理报案、控告、举报、投案后，觉得属于违抗次第约束行为的，应当立即进行探听；觉得不属于违抗次第约束行为的，应当请问报案东说念主、控告东说念主、举报东说念主、投案东说念主，并说明意义。
Article 78 After accepting acase reported, accused, or informed of or a voluntary surrender,which the public security organ considers to be an act against theadministration of public security, it shall immediately conductinvestigation; otherwise, it shall notify the reporter, accuser orinformant, or the person who surrenders himself to the police of thefact and explain the reasons.
第七十九条 公安机关偏执东说念主民考查对次第案件的探听，应当照章进行。严禁刑讯逼供或者遴荐威胁、提示、欺骗等造孽本事汇集把柄。
Article 79 Public securityorgans and the people’s police shall investigate cases of publicsecurity according to law Extorting confessions by torture orcollecting evidence by such illegal means as intimidation, enticementor deception is strictly prohibited.
以造孽本事汇集的把柄不适当作处罚的根据。

第八十条 公安机关偏执东说念主民考查在办理次第案件时，对触及的国度巧妙、交易巧妙或者个东说念主阴事，应当给以守密。
Article 80 When publicsecurity organs and the people’s police deal with cases of publicsecurity, which involve State secret, commercial secret or individualprivacy, they shall keep the secret.
第八十一条 东说念主民考查在办理次第案件流程中，遇有下列情形之一的，应当躲闪；违抗次第约束行为东说念主、被侵害东说念主或者其法定代理东说念主也有权要求他们躲闪：
Article 81 Where a people’spoliceman comes under one of the following circumstances when dealingwith a case of public security, he shall withdraw; and the person whocommits an act against the administration of public security, thevictim, their statutory representative shall have the right to demandthe policeman’s withdrawal:
（一）是本案当事东说念主或者当事东说念主的嫡支属的；
(1) being a party or a close relative of the party tothe case;
（二）本东说念主或者其嫡支属与本案有意害关系的；
(2) he or a close relative of his has an interest in thecase; or
（三）与本案当事东说念主有其他关系，可能影响案件公平处理的。
(3) having other relations with a party to the case,which may affect the impartial handling of the case.
东说念主民考查的躲闪，由其所属的公安机关决定；公安机关肃穆东说念主的躲闪，由上一级公安机关决定。
The withdrawal of a people’s policeman shall bedecided by the public security organ which he belongs to; and thewithdrawal of a leading person of a public security organ shall bedecided by the public security organ at the next higher level.
第八十二条 需要传唤违抗次第约束行为东说念主接受探听的，经公安机关办案部门肃穆东说念主批准，使用传唤证传唤。对现场发现的违抗次第约束行为东说念主，东说念主民考查经出示职责证件，不错理论传唤，但应当在商酌笔录中注明。

第八十三条 对违抗次第约束行为东说念主，公安机关传唤后应当实时商酌查证，商酌查证的时候不得跳跃八小时；情况复杂，依照本法例矩可能适用行政拘留处罚的，商酌查证的时候不得跳跃二十四小时。
Article 83 Immediately afterthe person who commits an act against the administration of publicsecurity answers the summons, the public security organ shall conductinterrogation and investigation, which shall not exceed eight hours;and if the circumstances are complicated and, according to theprovisions of this Law, a penalty of administrative detention may beapplied, the time for the interrogation and investigation shall notexceed 24 hours.
公安机关应当实时将传唤的原因和地点请问被传唤东说念主家属。
The public security organ shall, without delay, notifythe family members of the person summoned of the reasons for thesummons and the place of detention.
第八十四条 商酌笔录应当交被商酌东说念主查对；对莫得阅读才能的，应当向其宣读。纪录有遗漏或者谬误的，被商酌东说念主不错提议补充或者转变。被商酌东说念主阐述笔录无误后，应当签名或者盖章，商酌的东说念主民考查也应当在笔录上签名。
Article 84 The written recordof interrogation shall be checked by the interrogated; and if thelatter does not have the ability to read, the written record shall beread out to him If there are omissions or errors in the record, theinterrogated may request supplements or corrections to be made Whenthe interrogated confirms that the written record is free of error,he shall sign or affix his seal on it, and the people’s policemanwho does the interrogation shall sign the record as well.
被商酌东说念主要求就被商酌事项自行提供书面材料的，应当准许；必要时，东说念主民考查也不错要求被商酌东说念主自行书写。
If the interrogated requests, of his own accord, toprovide written materials on the matters interrogated, permissionshall be given; and when necessary, the people’s policeman may alsorequest the interrogated to write down the materials himself.
商酌不悦十六周岁的违抗次第约束行为东说念主，应当请问其父母或者其他监护东说念主到场。
When a person who commits an act against theadministration of public security and who has not attained to the ageof 16 is to be interrogated, his parents or guardian shall benotified of the need to be present.
第八十五条 东说念主民考查商酌被侵害东说念主或者其他证东说念主，不错到其所在单元或者住处进行；必要时，也不错请问其到公安机关提供证言。
Article 85 To interrogate avictim or other witness, the people’s policeman may do it in theunit which he belongs to or at the place where he lives; and whennecessary, the people’s policeman may also notify the victim orwitness that he comes to the public security organ to providetestimony.
东说念主民考查在公安机关除外商酌被侵害东说念主或者其他证东说念主，应当出示职责证件。
When a people’s policeman interrogate a victim orother witness outside of the public security organ, he shall show hiswork certificate.
商酌被侵害东说念主或者其他证东说念主，同期适用本法第八十四条的规则。
The provisions of Article 84 of this Law are, at thesame time, applicable to the interrogation of a victim or otherwitness.
第八十六条 商酌聋哑的违抗次第约束行为东说念主、被侵害东说念主或者其他证东说念主，应当有邃晓手语的东说念主提供匡助，并在笔录上注明。
Article 86 If the personcommitting an act against the administration of public security, thevictim or other witness who is deafmuteis interrogated, assistance shall be provided by persons who have agood command of the sign language, which shall be noted clearly inthe written record of the interrogation.
商酌欠亨晓当地通用的话语翰墨的违抗次第约束行为东说念主、被侵害东说念主或者其他证东说念主，应当配备翻译东说念主员，并在笔录上注明。
If the person committing an act against theadministration of public security, the victim or other witness who isnot familiar with the spoken or written language common in use in thelocality is interrogated, interpreters shall be provided, which shallbe noted clearly in the written record of the interrogation.
第八十七条 公安机关对与违抗次第约束行为相关的步地、物品、东说念主身不错进行检察。检察时，东说念主民考查不得少于二东说念主，并应当出示职责证件和县级以上东说念主民政府公安机关开具的检察评释文献。对确有必要立即进行检察的，东说念主民考查经出示职责证件，不错就地检察，但检察公民住所应当出示县级以上东说念主民政府公安机关开具的检察评释文献。
Article 87 The publicsecurity organ may inspect the place, Articles and person related toan act against the administration of public security For suchinspection, there shall be two policemen at least, and they shallshow their work certificates and the certificating document forinspection issued by public security organ under the people’sgovernment at or above the county level Where it is really necessaryto conduct inspection immediately, the policemen may, upon showingtheir work certificates, conduct inspection on the spot; however, toinspect the domicile of a citizen, they shall show the certificatingdocument for inspection issued by the public security organ under thepeople’s government at or above the county level.
检察妇女的肉体，应当由女性职责主说念主员进行。
Inspecting the person of a woman shall be done by femaleworkers.
第八十八条 检察的情况应当制作检察笔录，由检察东说念主、被检察东说念主和见证东说念主签名或者盖章；被检察东说念主拒绝签名的，东说念主民考查应当在笔录上注明。
Article 88 A written recordof the inspection shall be made, which shall be signed by or affixedwith the seals of the inspectors, the inspected and the witnesses;and if the inspected refuses to sign his name, the people’s policeshall state the fact clearly in the written record.
第八十九条 公安机关办理次第案件，对与案件相关的需要当作把柄的物品，不错扣押；对被侵害东说念主或者善意第三东说念主正当占有的财产，不得扣押，应当给以登记。对与案件无关的物品，不得扣押。
Article 89 For handling acase of public security, the public security organ may distrain theArticles that are related to the case and need to be taken asevidence; and it shall not distrain the property lawfully possessedby the victim or the bonafidethird party, but shall have such property registered It shall notdistrain Articles that are not related to the case.
对扣押的物品，应当会同在场见证东说念主和被扣押物品持有东说念主查点明晰，就地开列清单一式二份，由探听东说念主员、见证东说念主和持有东说念主签名或者盖章，一份交给持有东说念主，另一份附卷备查。
The number of the Articles distrained shall be checkedaccurately together with the witnesses on the spot and the person whopossesses those Articles, and a list of such Articles shall beprepared in duplicate on the spot, which shall be signed by oraffixed with the seals of the inspectors, witnesses and thepossessor, and of which one copy shall be given to the possessor andthe other shall be attached to the file of case for the reference.
对扣押的物品，应当妥善撑持，不得挪作他用；对不宜长久保存的物品，按摄影关规则处理。经查明与案件无关的，应当实时退还；经核实属于他东说念主正当财产的，应当登记后立即退还；满六个月无东说念主对该财产办法权利或者无法查清权利东说念主的，应当公开拍卖或者按照国度相关规则处理，所得款项上缴国库。
The Articles distrained shall be preserved properly andnot be used for other purposes; and the Articles unsuitable to bekept for a long period of time shall be disposed of in accordancewith relevant regulations The Articles proved to be unrelated to thecase upon investigation shall be returned immediately; the Articlesthat belong to the lawful property of another person uponverification shall be immediately returned after they are registered;and if at the expiration of six months nobody lays claim to suchproperty or there is no way of identifying the obligees, the Articlesshall be publicly sold by auction or be disposed of in accordancewith the relevant regulations of the State, and the proceedstherefrom shall be handed over to the State Treasury.
第九十条 为了查明案情，需要科罚案件中有争议的专门性问题的，应当指派或者聘用具有专门学问的东说念主员进行轻狂；轻狂东说念主轻狂后，应当写出轻狂倡导，况且签名。
Article 90 Where it isnecessary to solve the special problems in dispute in a case for thepurpose of finding out the truth of the case, persons with specialknowledge shall be designated or invited to make appraisal; and afterappraisal, the experts shall write down their opinions and sign theirnames.
第二节 决 定
Section 2 Decision
第九十一条 次第约束处罚由县级以上东说念主民政府公安机关决定；其中告诫、五百元以下的罚金不错由公安派出所决定。
Article 91 Penalties foradministration of public security shall be decided on by publicsecurity organs under the people’s government at or above thecounty level, among which, a warning or a fine of not more than 500yuan may be decided on by local police stations.
第九十二条 对决定给予行政拘留处罚的东说念主，在处罚前如故采纳强制要领限制东说念主身解放的时候，应当折抵。限制东说念主身解放一日，折抵行政拘留一日。
Article 92 With regard to aperson, before the decision on a penalty of administrative detentionis made, a compulsory measure for restricting his freedom of personhas been adopted, the period of time for such measure shall be offsetOne day of restricted freedom of person shall be offset against oneday of administrative detention.
第九十三条 公安机关查惩罚安案件，对莫得本东说念主评释，但其他把柄好像评释案件事实的，不错作出次第约束处罚决定。可是，惟有本东说念主评释，莫得其他把柄评释的，不成作出次第约束处罚决定。
Article 93 In investigatingand handling a case of public security, the public security organmay, in the absence of statements made by the offender, make adecision on a penalty for administration of public security, when thefacts of the case can be proved by other evidence However, wherethere are only statements made by the offender but no other evidenceto prove the facts, the decision on a penalty for administration ofpublic security shall not be made.
第九十四条 公安机关作出次第约束处罚决定前，应当请问违抗次第约束行为东说念主作出次第约束处罚的事实、意义及依据，并请问违抗次第约束行为东说念主照章享有的权利。
Article 94 Before making adecision on a penalty for administration of public security, thepublic security organ shall notify the person who commits an actagainst the administration of public security of the facts, reasonsand basis for such penalty, as well as of the rights he enjoysaccording to law.
违抗次第约束行为东说念主有权评释和辩护。公安机关必须充分听取违抗次第约束行为东说念主的倡导，对违抗次第约束行为东说念主提议的事实、意义和把柄，应当进行复核；违抗次第约束行为东说念主提议的事实、意义或者把柄成就的，公安机关应当接收。
A person who commits an act against the administrationof public security shall have the right to make statements and defendhimself The public security organ must fully listen to the opinionsof the said person and shall review the facts, reasons and evidenceput forth by the person; and if the facts, reasons or evidence putforth by the person are tenable, the public security organ shallaccept them.
公安机关不得因违抗次第约束行为东说念主的评释、辩护而加剧处罚。
The public security organ shall not impose a heavierpenalty on the person who commits an act against the administrationof public security because the person has made his statements ordefended himself.
第九十五条 次第案件探听达成后，公安机关应当根据不哀怜况，分歧作出以下处理：
Article 95 After theinvestigation into a case of public security is concluded, the publicsecurity organ shall make a decision, on the merits of the case, asfollows:
（一）确有照章应当给予次第约束处罚的违法戾为的，根据情节轻重及具体情况，作出处罚决定；
(1) if the illegal act has certainly been committed forwhich a penalty for administration of public security should beimposed according to law, a decision to such an effect shall be madein light of the seriousness of the circumstances and actualsituation;
（二）照章不予处罚的，或者违法事实不成成就的，作出不予处罚决定；
(2) if no penalty should be imposed according to law, orthe fact about the illegal act are untenable, a decision on nopenalty shall be made;
（三）违法戾为已涉嫌作歹的，移送主宰机关照章讲究处分；
(3) if the illegal act is suspected of being a crime,the case shall be transferred to a competent organ which shallinvestigate the criminal responsibility according to law; or
（四）发现违抗次第约束行为东说念主有其他违法戾为的，在对违抗次第约束行为作出处罚决定的同期，请问相关行政主宰部门处理。
(4) when finding that the person who commits an actagainst the administration of public security has committed otherillegal acts, it shall, while making a decision on penalty for thesaid act, notify the relevant administrative department in charge forhandling the case.
第九十六条 公安机关作出次第约束处罚决定的，应当制作次第约束处罚决定书。决定书应当载明下列试验：
Article 96 When the publicsecurity organ makes a decision on penalty for administration ofpublic security, it shall make a written decision on such penalty Inthe written decision the following shall clearly be stated:
（一）被处罚东说念主的姓名、性别、年级、身份证件的称号和号码、住址；
(1) the name, sex, age, title and number of identitycard, and address of the person penalized;
（二）违法事实和把柄；
(2) facts and evidence of the illegal act committed;
（三）处罚的种类和依据；
(3) type and basis of the penalty;
（四）处罚的执行气象和期限；
(4) means for executing the penalty and the period oftime of the penalty;
（五）对处罚决定不屈，恳求行政复议、拿起行政诉讼的阶梯和期限；
(5) channels and time limit for making an applicationfor administrative reconsideration or for bringing an administrativesuit if a person is dissatisfied with the decision on penalty; and
（六）作出处罚决定的公安机关的称号和作出决定的日历。
(6) name of the public security organ that makes thedecision on penalty and the date on which such a decision is made
决定书应当由作出处罚决定的公安机关加盖章章。
The seal of the public security organ that makes thedecision on penalty shall be affixed to the written decision.
第九十七条 公安机关应当向被处罚东说念主宣告次第约束处罚决定书，并就地寄托被处罚东说念主；无法就地向被处罚东说念主宣告的，应当在二日内投递被处罚东说念主。决定给予行政拘留处罚的，应当实时请问被处罚东说念主的家属。
Article 97 The publicsecurity organ shall read out the written decision on penalty foradministration of public security to the person penalized, and handit over to him on the spot; and where there is no way of reading itout to such person on the spot, the written decision shall be servedon the person within two days Where a decision on penalty ofadministrative detention is made, the family members of the personpenalized shall be notified without delay.
有被侵害东说念主的，公安机关应当将决定书副本抄送被侵害东说念主。
Where there is a victim in the case, the public securityorgan shall send a duplicate of the written decision to the victim.
第九十八条 公安机关作出根除许可证以及处二千元以上罚金的次第约束处罚决定前，应当请问违抗次第约束行为东说念主有权要求举行听证；违抗次第约束行为东说念主要求听证的，公安机关应当实时照章举行听证。
Article 98 Before deciding torevoke the license or to impose a fine of not less than 2,000 yuan asa penalty for the administration of public security, the publicsecurity organ shall notify the person who commits an act against theadministration of public security that he has the right to demand theholding of a hearing; and where the said person demands a hearing,the public security organ shall, in a timely manner, hold the hearingaccording to law.
第九十九条 公安机关办理次第案件的期限，自受理之日起不得跳跃三旬日；案情要害、复杂的，经上一级公安机关批准，不错延迟三旬日。
Article 99 The period of timefor the public security organ to handle a case of public securityshall not exceed 30 days from the date it accepts case; and where itis a major and complicated case, the period of time may be extendedfor another 30 days upon approval by the public security organ at thenext higher level.
为了查明案情进行轻狂的时间，不计入办理次第案件的期限。
Thetime for making evaluation in order to find out the facts about acase shall not be counted into the period of time for handling a caseof public security.
第一百条 违抗次第约束行为事实明晰，把柄可信，处告诫或者二百元以下罚金的，不错就地作出次第约束处罚决定。
Article 100 Where the factsabout the act committed against the administration of public securityare clear and the evidence is irrefutable, for which a warning is tobe given or a fine of not more than 200 yuan is to be imposed, thedecision on such a penalty for administration of public security maybe made on the spot.
第一百零一条 就地作出次第约束处罚决定的，东说念主民考查应当向违抗次第约束行为东说念主出示职责证件，并填写处罚决定书。处罚决定书应当就地寄托被处罚东说念主；有被侵害东说念主的，并将决定书副本抄送被侵害东说念主。
Article 101 Where a decisionon a penalty for administration of public security is made on thespot, the people’s policeman shall show his work certificate to theperson who commits an act against the administration of publicsecurity, and fill out a written decision on the penalty The writtendecision on the penalty shall, on the spot, be handed over to theperson penalized; and where there is a victim in the case, theduplicate of the written decision shall be sent to him.
前款规则的处罚决定书，应当载明被处罚东说念主的姓名、违法戾为、处罚依据、罚金数额、时候、地点以及公安机关称号，并由承办的东说念主民考查签名或者盖章。
In the written decision on the penalty mentioned in thepreceding paragraph shall clearly be stated the name of the personpenalized, the illegal act, the basis for the penalty, the amount ofthe fine, the date, place, and the title of the public securityorgan, and the written decision shall be signed by or affixed withthe seal of the people’s policeman who handles the case.
就地作出次第约束处罚决定的，承办的东说念主民考查应当在二十四小时内报所属公安机关备案。
Where the decision on a penalty for administration ofpublic security is made on the spot, the people’s policeman whohandles the case shall, within 24 hours, report the matter for therecord to the public security organ which he belongs to.
第一百零二条 被处罚东说念主对次第约束处罚决定不屈的，不错照章恳求行政复议或者拿起行政诉讼。
Article 102 Where the personpenalized is not satisfied with the decision on penalty foradministration of public security, he may apply for administrativereconsideration or bring an administrative suit according to law.
第三节 执行
Section 3 Execution
第一百零三条 对被决定给予行政拘留处罚的东说念主，由作出决定的公安机关投递拘留所执行。
Article 103 The person onwhom the penalty for administrative detention is imposed upondecision shall be delivered by the public security organ to the houseof detention for execution of the decision it made.
第一百零四条 受到罚金处罚的东说念主应当自收到处罚决定书之日起十五日内，到指定的银行缴纳罚金。可是，有下列情形之一的，东说念主民考查不错就地收缴罚金：
Article 104 The person onwhom a fine is imposed as a penalty shall pay the fine to adesignated bank within 15 days from the date he receives the writtendecision on the penalty However, under one of the followingcircumstances, the people’s policeman may collect the fine on thespot:.
（一）被处五十元以下罚金，被处罚东说念主对罚金无异议的；
(1) if the amount of the fine imposed is not more than50 yuan and the person penalized has no objection to the fine;
（二）在迢遥、水上、交通未便地区，公安机关偏执东说念主民考查依照本法的规则作出罚金决定后，被处罚东说念主向指定的银行缴纳罚金确有困难，经被处罚东说念主提议的；
(2) if in an outlying area, or on water, or in a placenot easily accessible where the public security organ or the people’spoliceman makes a decision on a fine in accordance with theprovisions of this Law, the person penalized makes such a proposalbecause it is really difficult for him to pay the fine to thedesignated bank; or
（三）被处罚东说念主在当地莫得固定住所，不就地收缴过后难以执行的。
(3) if it is difficult to enforce the penalty unless thefine is collected on the spot, because the person penalized has nopermanent dwelling place in the locality.
第一百零五条 东说念主民考查就地收缴的罚金，应当自收缴罚金之日起二日内，交至所属的公安机关；在水上、搭客列车上就地收缴的罚金，应当自抵岸或者到站之日起二日内，交至所属的公安机关；公安机关应当自收到罚金之日起二日内将罚金缴付指定的银行。
Article 105 The people’spoliceman who collects a fine on the spot shall, within two days fromthe date he collects the fine, hand the fine over to the publicsecurity organ which he belongs to; if a fine is collected on thespot on water or aboard a train, he shall, within two days from thedate he arrives at the port or railway station, hand the fine over tothe public security organ which he belongs to; and the publicsecurity organ shall, within two days from the date it receives thefine, hand the fine over to the designated bank.
第一百零六条 东说念主民考查就地收缴罚金的，应当向被处罚东说念主出具省、自治区、直辖市东说念主民政府财政部门统一制发的罚金收条；不出具统一制发的罚金收条的，被处罚东说念主有权拒绝缴纳罚金。
Article 106 When a people’spoliceman collects a fine on the spot, he shall produce to the personpenalized a voucher for the fine which is uniformly printed andissued by the finance department of the people’s government of aprovince, autonomous region, or municipality directly under theCentral Government; and if no such voucher is produced, the personpenalized shall have the right to refuse to pay the fine.
第一百零七条 被处罚东说念主不屈行政拘留处罚决定，恳求行政复议、拿起行政诉讼的，不错向公安机关提议暂缓执行行政拘留的恳求。公安机关觉得暂缓执行行政拘留不致发生社会危急的，由被处罚东说念主或者其嫡支属提议相宜本法第一百零八条文矩条目的担保东说念主，或者按逐日行政拘留二百元的标准缴纳保证金，行政拘留的处罚决定暂缓执行。
Article 107 Where a personpenalized who refuses to accept the decision on a penalty ofadministrative detention applies for administrative reconsiderationor bring an administrative suit, he may apply to the public securityorgan for a deferred enforcement of the administrative detention Ifthe public security organ believes that such deferment will notcreate danger to the society, and after the person penalized or hisclose relative proposes a guarantor who conforms to the conditionsprovided for in
Article 108 of this Law, or after the bail is paid atthe rate of 200 yuan per day for the administrative detention, thedecision on the penalty of administrative detention shall be deferredfrom enforcement.
第一百零八条 担保东说念主应当相宜下列条目：
Article 108 A guarantor shallmeet the following conditions:
（一）与本案无株连；
(1) being not involved in the case concerned;
（二）享有政事权利，东说念主身解放未受到限制；
(2) enjoying political rights, and his freedom of personbeing not restricted;
（三）在当地有常居民口和固定住所；
(3) having a permanent registered residence and apermanent dwelling locally; and
（四）有才能履行担保义务。
(4) having the ability to perform the obligations of aguarantor.
第一百零九条 担保东说念主应当保证被担保东说念主不走避行政拘留处罚的执行。
Article 109 A guarantor shallguarantee that the person guaranteed will not escape from theenforcement of the penalty of administrative detention.
担保东说念主不履行担保义务，甚而被担保东说念主走避行政拘留处罚的执行的，由公安机关对其处三千元以下罚金。
Where the guarantor fails to perform his obligations, sothat the person guaranteed escapes from the enforcement of thepenalty of administrative detention, the public security organ shallimpose on him a fine of not more than 3,000 yuan.
第一百一十条 被决定给予行政拘留处罚的东说念主缴纳保证金，暂缓行政拘留后，走避行政拘留处罚的执行的，保证金给以充公并上缴国库，如故作出的行政拘留决定仍应执行。
Article 110 Where a person onwhom the penalty of administrative detention is imposed upon decisionescapes from the enforcement of the penalty after payment of the bailfor deferred execution of the administrative detention, the bailshall be confiscated and handed over to the State Treasury, and thedecision already made on the penalty of administrative detentionshall be executed all the same.
第一百一十一条 行政拘留的处罚决定被破除，或者行政拘留处罚启动执行的，公安机关收取的保证金应当实时退还缴纳东说念主。
Article 111 Where thedecision on penalty of administrative detention is withdrawn, or thepenalty of administrative detention begins to be executed, the bailcollected by the public security organ shall be returned to the payerwithout delay.
第五章 司法监督Chapter V Law Enforcement Supervision第一百一十二条 公安机关偏执东说念主民考查应当照章、公平、严格、高效办理次第案件，文静司法，不得两袖清风。
Article 112 Public securityorgans and the people’s police shall handle cases of publicsecurity according to law and in an impartial, strict and highlyefficient manner, and enforce laws with civility, and they shall notengage in malpractices for private gain.
第一百一十三条 公安机关偏执东说念主民考查办理次第案件，谢彻底违抗次第约束行为东说念主打骂、残酷或者侮辱。
Article 113 In handling casesof public security, public security organs and the people’s policeare forbidden to beat, abuse, mistreat or humiliate the persons whocommit acts against the administration of public security.
第一百一十四条 公安机关偏执东说念主民考查办理次第案件，应当自愿接受社会和公民的监督。
Article 114 In handling casesof public security, public security organs and the people’s policeshall voluntarily accept supervision by the society and citizens.
公安机关偏执东说念主民考查办理次第案件，不严格司法或者有违法违章行为的，任何单元和个东说念主皆有权向公安机关或者东说念主民检察院、行政监察机关检举、控告；收到检举、控告的机关，应当依据职责实时处理。
Where a public security organ and people’s policemanfails to strictly enforce laws in handling cases of public securityor commits an act in violation of laws or discipline, any unit orindividual shall have the right to report to or lodge an accusationbefore a public security organ or the people’s procuratorate or anadministrative supervisory organ; and the organ that receives suchreport or accusation shall, without delay, handle it in compliancewith its duties.
第一百一十五条 公安机关照章实施罚金处罚，应当依摄影关法律、行政法例的规则，实行罚金决定与罚金收缴分离；收缴的罚金应当沿途上缴国库。
Article 115 When executingthe penalty of a fine according to law, the public security organshall, in accordance with the provisions of relevant laws andadministrative regulations, separate the decisionmakingon fines from the collection of fines; and all the fines collectedshall be handed over to the State Treasury.
第一百一十六条 东说念主民考查办理次第案件，有下列行为之一的，照章给予行政处分；组成作歹的，照章讲究处分：
Article 116 If when handlingcases of public security, a people’s policeman commits one of thefollowing acts, he shall be given an administrative sanctionaccording to law; and if a crime is constituted, he shall beinvestigated for criminal responsibility according to law:
（一）刑讯逼供、体罚、残酷、侮辱他东说念主的；
(1) extorting a confession by torture, or physicallypunishing, maltreating or humiliating another person;
（二）跳跃商酌查证的时候限制东说念主身解放的；
(2) exceeding the period of time set for interrogation,investigation and verification, thus restricting the freedom ofperson;
（三）不执行罚金决定与罚金收缴分离轨制或者不按规则将罚没的财物上缴国库或者照章处理的；
(3) failing to carry out the system of separating thedecision on fines from the collection of fines or failing to hand thefines collected or the property confiscated over to the StateTreasury in accordance with the provisions or failing to dispose ofsuch property according to law;
（四）私分、侵占、挪用、挑升损毁收缴、扣押的财物的；
(4) privately dividing, seizing, misappropriating orintentionally damaging the money or things of value collected ordistrained;
（五）违抗规则使用或者不足时返还被侵害东说念主财物的；
(5) in violation of regulations, using or failing toreturn the property or things of value to the victim;
（六）违抗规则不足时退还保证金的；
(6) in violation of the provisions, failing to returnthe bails in a timely manner;
（七）期骗职务上的便利袭取他东说念主财物或者谋取其他利益的；
(7) taking the advantage of the position to acceptor receive the property or things of value from another person orseek other benefits;
（八）就地收缴罚金不出具罚金收条或者不真的填写罚金数额的；
(8) failing to produce a voucher for a fine collected onthe spot or failing to truthfully fill out the amount of a fine;
（九）接到要求制止违抗次第约束行为的报警后，不足时出警的；
(9) failing to dispatch the police to the scene as soonas receiving a request for stopping an act against the administrationof public security;
（十）在查处违抗次第约束行为时，为违法作歹行为东说念主透风报信的；
(10) sending secret messages to a person who violatesthe law or commits a crime, when investigating and handlingactivities against the administration of public security; or
（十一）有两袖清风、铺张权益，不照章履行法定职责的其他情形的。
(11) other acts involving engagement in malpractices forpersonal gain, abuse of power or failure to perform the statutoryduties according to law.
办理次第案件的公安机关有前款所列行为的，对胜利肃穆的主宰东说念主员和其他胜利牵累东说念主员给予相应的行政处分。
Where in handling cases of public security, a publicsecurity organ commits one of the acts mentioned in the precedingparagraph, the persons directly in charge and the other personsdirectly responsible shall be given appropriate administrativesanctions.
第一百一十七条 公安机关偏执东说念主民考查违法戾使权益，扰乱公民、法东说念主和其他组织正当权益的，应当赔礼说念歉；酿成挫伤的，应当照章承担抵偿牵累。
Article 117 Where publicsecurity organs and the people’s police unlawfully exercise theirfunctions and powers and infringe upon the legitimate rights andinterests of citizens, legal persons or other organizations, theyshall make apologies; and where damages are caused, they shall bearthe responsibility for compensation according to law.
第六章 附 则Chapter VI Supplementary Provisions第一百一十八条 本法所称以上、以下、以内，包括本数。
Article 118 The figures usedfollowing the terms of “not less than”, “not more than” or“within” in this Law include these figures themselves.
第一百一十九条 本法自2006年3月1日起彭胀。1986年9月5日公布、1994年5月12日改良公布的《中华东说念主民共和国次第约束处罚条例》同期废止。
